These Terms of Use (“Terms”) govern your access to and use of the website located at atlasds.com and any subdomains or online services owned or controlled by Atlas Data Storage, Inc. (collectively, the “Site”).
1. ACCEPTANCE AND PRIVACY
1.1 Acceptance. By accessing the Site, you agree to these Terms. If you do not agree, you must cease use of the Site immediately.
1.2 Privacy Policy. Your privacy is important to us. Our Privacy Statement describes how we collect, use, and disclose your personal information. By using the Site, you acknowledge that you have read and understood our Privacy Statement.
2. INTELLECTUAL PROPERTY & FEEDBACK
2.1 Ownership. Atlas Data Storage, Inc. and its licensors own and retain all right, title, and interest in the Site’s technology, text, code, and design. No license is granted to you except for the limited right to access the Site for informational purposes.
2.2 Feedback. If you provide us with any suggestions or “Improvements” via our contact forms, you hereby grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback into our products or services without any obligation to you.
3. RESTRICTIONS ON USE
You shall not: (a) “scrape” or use automated systems to extract data; (b) interfere with the Site’s security or our analytics tools (Google Analytics, HubSpot, HotJar); or (c) use the Site to transmit malicious code or unauthorized advertising.
4. DISCLAIMERS & LIMITATION OF LIABILITY
4.1 “As-Is” Basis. The Site is provided for informational purposes only. We make no warranties regarding the accuracy or completeness of the content.
4.2 Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS DATA STORAGE, INC.’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED $50.00.
5. INTERNATIONAL USE & TRANSFERS
The Site is controlled and operated from the United States. If you access the Site from the European Economic Area (EEA), United Kingdom, or other regions with laws governing data collection and use, please note that you are transferring your personal data to the United States. By providing your data via our “Contact Us” forms, you acknowledge this transfer.
6. GOVERNING LAW & SEVERABILITY
6.1 Governing Law. These Terms are governed by the laws of the State of California.
6.2 Severability. If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
